Quu Privacy Policy

Quu Inc. is committed to protecting the privacy of your personal information.  This Privacy Policy applies to information Quu learns about or obtains from you when you visit the Quu website (the “Site”) and when you use Quu’s products and services, including the Quumobile Software and Quu Services.  Quu may modify this Privacy Policy from time to time, in Quu’s discretion and as provided by applicable law.  You should check this Privacy Policy frequently for any changes, but in any event your continued access and use of the Site or the Quu products and services will constitute your acceptance of any such modifications.  Quu’s use of information gathered or obtained at any time is subject to the Privacy Policy in effect at the time of such use.

WHAT PERSONAL INFORMATION DOES Quu COLLECT?
Quu collects personal information in order to communicate with you and provide customer support, facilitate use of the Site and our products and services and to improve the Site.  We will not disclose personally-identifiable information we collect from you to third parties without your consent, except as provided in this Privacy Policy, the Quu Website Terms or another agreement between you and Quu.

Information You Give Us.  In order to download Quu’s software or purchase our products or services, you must open an account or register on-line.  Information we collect during registration or account set-up or during your access or use of the Quumobile Software or Quu Services or any other product or service we offer may differ depending on the nature of the product or service, and can include your personal information such as name, email, mobile phone number, information regarding software you download and information regarding your mobile phone, your computer and regarding songs, advertisements and other content and information that you “Quu.”  Of course, you can choose not to provide such information, but then you might not be able to access or use certain portions of the Site or the Quu products or services.  Quu will not sell, distribute or disclose your personally-identifiable information to third parties without your consent, except as provided in this Privacy Policy.

QuuFriends and Your Profile.  You may add other Quu members as friends (“QuuFriends”) and other members may add you as a QuuFriend.  Your user name and other information and materials you choose to upload (e.g., your photograph, personal bio, location, favorite radio stations) to your profile will be available to your QuuFriends.  You and your QuuFriends will also receive notices (on your mobile telephone or email account) when any of you add or favorite a song or radio station to your Quu, or indicate that you are listening to a specific radio station.  You can always choose to turn off a QuuFriend, and stop receiving such notices.

Automated Information Collection.  In addition to information you provide, Quu automatically receives and stores certain types of information every time you visit the Site.  We may collect the name of the domain and host from which you access the Internet, the IP address of the computer you are using and the browser and operating system you are using, the date and time you access the Site and the address of the website from which you accessed the Site.  We use “cookies” to automatically gather some of this information.  A cookie is a small text file that the Site system sends to your computer to collect information about your activities on the Site. The cookie transmits this information back to the Site each time your browser requests a page from the Site, and the information is stored to help facilitate your use of the Site the next time you visit, and may be used as otherwise provided under this Privacy Policy.  If you do not want to receive cookies from the Site, you can set your browser to not accept cookies, but then you may not be able to access or use certain portions of the Site or the Quu products and services.  You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it.

HOW DOES Quu USE YOUR INFORMATION?
We use the information you provide and we collect to:

• Administer the Site and Quu Services and diagnose problems with our server and Quumobile Software and Quu Services;

• Verify your identity and respond to your requests for information;

• Notify you of updates for downloaded products;

• Provide you with newsletters and updates;

• Provide you with rebates and special offers from certain Quu advertisers;

• Ask you to participate in surveys and offer you information about our products and services;

• Deliver to you and bill you for our products and services;

• Communicate with you concerning your account and customer service issues, including verifying authorization of credit card usage before purchases;

• Comply with applicable laws, statutes and regulations;

• Measure the number of visitors to the Site and how the Site and our products and services are used, in order to make the Site as useful as possible to our visitors;

• Determine if you meet the system requirements to download and use Quu’s products and services, and communicate with you regarding compatibility and interoperability; and

• As specifically provided in the Site Terms and as you may otherwise agree.

EMAIL FROM Quu
Opt-In
When you subscribe to Quu Services and download or install the Quumobile Software, you agree that we may use your email address or other personal information to send you information or otherwise communicate with you. 

Opt-Out
You can “opt out” of future emails by sending an empty email to stop.myquu.com.  If you opt out, we may continue to email you about products and services you have previously purchased, your account status and to inform you about service or other issues with Quu products and services.

Text Message FROM Quu
Opt-In
When you subscribe to Quu Services and download or install the Quumobile Software on your mobile phone, you agree that we may use your mobile phone number or other personal information to send you information and data and otherwise communicate with you, and that normal carrier charges (e.g., Text Message) and taxes may apply to data sent to you by Quu and to data transfers to your mobile phone.

Opt-Out
You can opt-out of receiving Text Message messages and other data downloads to your mobile telephone by selecting Menu – Unsubscribe or by sending a Text Message to 77859 with the word STOP in the body of the text.  If you opt-out, your Quumobile Software will no longer send or receive any messages.  You can reinstate messages by going to Menu – Subscribe.

TO WHOM DOES Quu DISCLOSE YOUR INFORMATION?
Quu may disclose information you provide and we collect to our parent and/or subsidiaries or affiliates, and as described below:

• To companies and individuals who perform services and other functions on our behalf;

• In the event Quu transfers some or all of its assets to another entity, or is acquired by a third party, information will likely be one of the transferred assets, but should remain subject to existing privacy terms as required by applicable law, statute or regulation;

• As we may decide is necessary to comply with applicable law and to enforce the Terms and Privacy Policy and/or protect the rights of Quu or third parties;

• To your QuuFriends, as discussed above;

• To your Quu’d radio stations, so that they can provide you with alerts; and

• As you may otherwise agree.

ANONYMIZED DATA
Quu may disclose demographic and other usage information collected through the Site, the Quumobile Software and Quu Services, but only after removing personally-identifiable information.

SUBPOENAS
Quu may respond to any subpoena received from a government agency (i.e., the Securities and Exchange Commission or law enforcement agencies) without prior notice to you.  Unless prohibited by law or by a court order, we will notify you of any subpoena received from any other party (e.g., for civil litigation) which requires us to disclose your identity, and will wait ten (10) days, or a lesser amount of time as required by the deadline in the subpoena, before providing the requested information.

LINKS
The Site may contain links to other websites and products, including links to retailers and other third parties regarding your Quu’d content.  Quu is not responsible for the privacy practices or the content of such other websites and products, including those sites with which we may have an affiliation.  You should review the privacy policies of other websites carefully before providing any information to such websites. 

SECURITY
The Quu Site has reasonable security measures in place to protect against the loss, misuse or alteration of information under Quu’s control.  While we strive to protect your personal information, Quu cannot ensure and does not warrant the security of any information.  Communication via the Internet is not failsafe, and there is always a possibility that data may be lost, or intercepted by unauthorized parties during transmission or after receipt by Quu.  You agree that Quu shall have no liability whatsoever in connection with such lost or intercepted data.

HOW TO ACCESS AND UPDATE YOUR PERSONAL INFORMATION
To modify or delete your personal information, sign in to your Quu account and click on the “account” link.  Personally identifiable information collected and transferred to back-up or archival storage may be retained indefinitely.  Quu may also retain information regarding your transactions as necessary for our business records, and as required under applicable law.

CHILDREN
The Site is not directed at children under the age of 13 and Quu does not knowingly permit submission of personal information by anyone under 13 years of age.

MISCELLANEOUS
Personal information you provide to Quu will be sent to and stored in servers in Quu’s headquarters in Mercer Island, Washington.  This Privacy Policy applies to all visitors and Quu customers worldwide. 

PERFORMANCE IS NOT ERROR FREE
Quu may release alpha and beta versions of products before the release of the final version. We may not always avoid unintended privacy issues with any versions of our products. Please let us know if you have any privacy concerns or any comments regarding the Site or our products and services.  We will make reasonable efforts to comply with this Privacy Policy, but Quu cannot and does not guarantee error-free performance under this Privacy Policy.  You agree that Quu shall have no liability for any incidental, consequential or punitive damages relating to this Privacy Policy. This Privacy Policy shall be governed by the laws of the United States.

CONDITIONS OF USE
Your access and use of the Site is subject to this Privacy Policy and the Terms of Use including limitations on damages, arbitration and the applicability of the law of the State of Washington.
